Terms of Service

Overview

These Terms of Service ("Terms") govern your use of the Munchie Maps platform, website, and mobile application (collectively, the "Service") operated by Munchie Maps ("we," "us," or "our").

Munchie Maps is a marketplace platform that connects food truck operators ("Vendors") with customers ("Customers") by displaying real-time food truck locations, menus, operating hours, and enabling online ordering where available.

Eligibility

To use the Munchie Maps Service, you must:

• Be at least 18 years of age, or 13 years of age with verifiable parental or guardian consent
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Provide accurate, complete, and current registration information
• Not have had a prior account terminated for violation of these Terms

Vendor Eligibility

Vendors must additionally hold all required business licenses, health permits, and food service certifications applicable in their jurisdiction, carry appropriate insurance coverage, comply with all applicable food safety regulations, and maintain an active subscription in good standing.

Your Account

You are responsible for maintaining the confidentiality of your login credentials, all activity that occurs under your account, and notifying us immediately at support@munchiemaps.com of any unauthorized use.

Customer Terms

Information Accuracy

Food truck menus, prices, hours, and locations are provided by Vendors and may not always be current or accurate. Always confirm with the Vendor directly regarding availability, ingredients, or allergens.

Allergen Responsibility

Munchie Maps does not verify allergen or nutritional information. If you have food allergies or dietary restrictions, you must contact the Vendor directly before ordering. We expressly disclaim any liability for allergic reactions or adverse health effects from consuming Vendor products.

Location Services

The accuracy of food truck locations depends on Vendor-provided real-time data. Displayed locations may not precisely reflect current physical locations. We are not responsible for inaccurate location information provided by Vendors.

Ratings and Reviews

Reviews must be based on genuine personal experience. You may not post false, misleading, defamatory, or retaliatory reviews. We reserve the right to remove reviews that violate these guidelines without notice.

Vendor Terms

Accurate Listings

You are solely responsible for the accuracy of all information in your listing including menu items, prices, descriptions, images, hours, and location data. You must update your listing promptly when information changes.

Order Fulfillment

When a customer places an order, you are obligated to fulfill it as described unless you reject it within a reasonable time. Repeated failure to fulfill accepted orders may result in account suspension.

No-Shows and Cancellations

If you mark an order as complete but the customer did not pick up, you retain the revenue. You are responsible for your own cancellation and refund policies, which must be clearly communicated to customers.

Food Safety

You must comply with all applicable food safety regulations and hold required permits. We reserve the right to remove listings that receive credible reports of food safety violations.

Independent Contractor

You are an independent contractor, not an employee, agent, or partner of Munchie Maps. Nothing in these Terms creates an employment, franchise, or agency relationship.

Alcohol Sales

Permits and Licenses Required

Vendors who list or sell alcoholic beverages through the platform represent and warrant that they:

• Hold a current, valid alcohol beverage license or permit issued by the applicable state or local authority (e.g., California ABC license) for every location where alcohol is sold
• Comply with all applicable federal, state, and local laws governing the sale, service, and distribution of alcohol, including but not limited to hours-of-sale restrictions, on-premise vs. off-premise limitations, and event-specific permit requirements
• Have trained staff who are certified in responsible alcohol service where required by law
• Maintain all required insurance coverage for alcohol liability (dram shop insurance) in jurisdictions where applicable
• Immediately update or remove alcohol listings if any required license expires, is suspended, or is revoked

Age Verification

Vendors are solely and exclusively responsible for verifying the age of every customer prior to completing any alcohol sale. Munchie Maps does not verify customer age and does not provide age-gating technology for individual transactions. Vendors must refuse service to any person who cannot provide valid government-issued identification confirming they are of legal drinking age in their jurisdiction (21 years of age in the United States).

Munchie Maps Is Not a Liquor Licensee

Munchie Maps holds no alcohol beverage license and is not a party to any alcohol transaction between a Vendor and a customer. Munchie Maps does not take possession of, title to, or control over any alcoholic beverages at any time. The Vendor is the sole seller and is solely responsible for all aspects of the alcohol transaction including legality, age verification, quantity limits, and safe service.

Indemnification for Alcohol Sales

In addition to the general indemnification in Section 13, Vendors who list or sell alcoholic beverages specifically agree to defend, indemnify, and hold harmless Munchie Maps from any claim, fine, penalty, lawsuit, or liability arising from:

• Sale of alcohol to a minor
• Sale of alcohol without a valid license or permit
• Violation of any dram shop law or alcohol liability statute
• Any injury, accident, or harm resulting from the sale or consumption of alcohol sold through the Vendor's listing
• Failure to verify customer age
• Any regulatory action, fine, or license suspension resulting from the Vendor's alcohol sales activities

Removal of Listings

Munchie Maps reserves the right to remove any alcohol-related menu items or listings at any time and without notice, at our sole discretion, including if we receive a credible report that a Vendor is selling alcohol without a valid license, selling to minors, or violating any applicable law. Removal of listings does not relieve the Vendor of liability for prior sales.

Subscriptions & Billing

Free Trial

New Vendor accounts may be eligible for a 30-day free trial on their first subscription. Free trials are limited to one per account across all restaurants registered under that account. A valid payment method is required to start a trial but you will not be charged until the trial ends.

Founder Plan

A limited number of Founding Member subscriptions are available at no cost for a two-month period. Founding memberships are limited to one per email address, non-transferable, and limited to 100 accounts total. After the founding period, a paid plan is required to continue using the Service.

Billing & Renewal

Subscriptions are billed monthly or annually and automatically renew unless you cancel before the renewal date. By providing a payment method, you authorize us to charge that method for all subscription fees.

Price Changes

We may change subscription prices with at least 30 days' advance notice by email. Continued use after a price change constitutes acceptance.

Refunds

Subscription fees are non-refundable except as required by applicable law. Cancellation provides access through the end of the current billing period with no partial refunds.

Upgrades

You may upgrade your plan at any time. Upgrades take effect immediately and you will be charged a prorated amount for the remainder of your current billing period at the new plan rate.

Orders & Payments

Order Placement

An order is confirmed when the Vendor accepts it. We reserve the right to cancel orders at any time for any reason including suspected fraud or system errors.

Pickup Only

All orders through Munchie Maps are currently pickup-only. Delivery is not available. Estimated ready times are provided by Vendors and are not guaranteed.

No-Shows

If you place an order and fail to pick it up within a reasonable time after it is marked ready, you may forfeit your payment. Repeated no-show behavior may result in suspension of your ordering privileges.

Disputes

Disputes regarding order quality or fulfillment are between you and the Vendor. Munchie Maps is not a party to transactions and has no obligation to mediate disputes. For payment disputes, contact your card issuer.

Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation
• Impersonate any person or misrepresent your affiliation with any entity
• Post false, misleading, defamatory, or fraudulent content
• Harass, threaten, or intimidate other users or Vendors
• Use automated means to access or interact with the Service without authorization
• Attempt to gain unauthorized access to any part of the Service or its systems
• Upload viruses or other malicious code
• Create multiple accounts to circumvent restrictions or bans
• Solicit customers to transact outside the platform
• List products that are illegal, unsafe, or misrepresented

Violation may result in immediate account suspension or termination and legal action where appropriate.

User Content

By submitting content (reviews, photos, menu items, etc.) you grant Munchie Maps a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

You are solely responsible for your content. We may remove any content at any time without notice. User Content must not be illegal, obscene, defamatory, threatening, or infringing of intellectual property rights.

Intellectual Property

All content, features, and functionality of the Service are the exclusive property of Munchie Maps or its content suppliers and are protected by applicable intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. This license does not include reselling or commercially exploiting the Service, data mining, or reproducing any portion of the Service without our express written permission.

Trademarks

Munchie Maps, the Munchie Maps logo, and all related marks are trademarks of Munchie Maps. You may not use these marks without our prior written permission.

Disclaimers

We do not warrant that the Service will be uninterrupted or error-free, that food truck locations are accurate at any given moment, that food quality will meet your expectations, or that Vendor information is current or accurate.

Food Safety Disclaimer

Munchie Maps does not inspect, certify, or guarantee the safety or quality of any food products offered by Vendors. Customers consume food truck products at their own risk.

Limitation of Liability

In no event shall Munchie Maps's total liability exceed the greater of the total amount you paid to Munchie Maps in the twelve months preceding the claim, or one hundred dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Munchie Maps and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Service, your User Content, your violation of any third-party rights, or for Vendors, any claims arising from your food products or business operations.

Termination

Termination by You

You may close your account at any time by contacting support@munchiemaps.com. Cancellation does not entitle you to a refund of prepaid fees.

Termination by Us

We may suspend or terminate your account immediately without notice for breach of these Terms. Upon termination, your right to use the Service ceases, your account may be permanently deleted, and for Vendors, your listing will be removed. Provisions that by their nature should survive termination will survive, including disclaimers, indemnity, and limitations of liability.

Disputes

Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting legal@munchiemaps.com. We will try to resolve the matter within 30 days.

Arbitration & Class Action Waiver

Any unresolved dispute shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association in Monterey, California. You and Munchie Maps agree that dispute resolution will be conducted only on an individual basis and not in a class or representative action.

Changes to These Terms

We may modify these Terms at any time. For material changes, we will update the "Last Updated" date, send an email notification to registered users, and display a notice within the app. Your continued use of the Service after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.
